Additional Information

SEC.300.106 Federal Definition - IDEA

In general, ESY refers to special education and/or related services provided beyond the normal school year of a school division for the purpose of providing FAPE to a student with a disability. The IEP team must determine whether the benefits the child gained during the regular school year will be significantly jeopardized if the student does not receive ESY. ESY will vary in type, intensity, location, inclusion of related services, and length of time, depending on the individual needs of the student.

ESY Eligibility Categories

The goals selected for ESY constitute a critical life skill AND there is one of the following:

  • Data showing Regression/Recoupment over a break
  • Degree of Progress is significantly limited and will affect life functioning
  • Student has an Emerging Skill that requires continued instruction to be maintained
  • Interfering Behaviors that require continuous instruction (the student likely has a BIP and/or a safety plan)
  • Nature and Severity – the areas of learning crucial to attaining the goal of self-sufficiency.
